1. INTRODUCTION

These Terms and Conditions shall apply to purchase in the e-shop www.creeme.eu (hereinafter referred to as “a Website”) operated by Creeme s.r.o located at Odborarska 1276/18, Bratislava, 831 02, Slovakia Business ID: 51069156 (hereinafter referred to as “a Seller”). The company is registered in the Business Register with the District Court Bratislava I. Terms and Conditions form an integral part of the concluded purchase contract between the buyer, on one hand, and the seller, on the other hand. Buyer shall mean the customer, the user of the Website, i.e. any visitor of the Website who has registered on the Website by filling in the obligatory registration data (name, surname, email address) and who placed an order through the Website www.creeme.eu (hereinafter referred to as “a Buyer”). The Contract shall mean any contract, irrespective of its legal form, which is concluded between the Seller and the Buyer.

2. Orders

All orders placed via www.creeme.eu are binding for both contracting parties. The Buyer chooses a product based on the actual offer published on the Website, confirms its selection by clicking on the button “Add to the shopping cart”, fills in the order form (e-mail, in case of product purchase also the delivery address), chooses the quantity of products (eventually specify the products parameters) and chooses the method of payment. Buyer’s personal data will not be provided to any third party. By placing an order, the Buyer confirms, by active clicking at the particular confirmation field that it acquainted itself and agreed with these Terms and Conditions at www.creeme.eu. The Buyer is obliged to pay the Seller the price of goods agreed in the order confirmation including costs for delivery of goods. After the order has been placed, a confirmation email will be sent to the Buyer’s email address specified in the order, the Seller confirms the acceptance of the order and its inclusion for processing, thereby concluding the Contract. If necessary, any further information regarding the order will be sent to the email address provided by the Buyer.

3. Information about the goods and prices

The price does not include shipping costs associated with the delivery of goods. Costs associated with the delivery of goods within the Slovak Republic, the Czech Republic, Belgium, the Netherlands, Poland, Austria, Hungary, Germany, Bulgaria, Greece, Finland, Italy, France, Sweden, Estonia are stated at the time of placing the order and are automatically included in the purchasing price of the goods. Colour of products may vary depending on your screen settings.

4. Withdrawal from the Contract and Returning the Goods

The Buyer has a right to withdraw from the Contract without stating the reason within 14 days from the day of takeover of the goods according to §7 of the Act N 102/2014 Coll. on Consumer Protection in sale of goods or provision of services based on a distance contract, or a contract concluded outside operational premises of the Seller and on amendment and supplement to certain acts as amended. The Buyer is obliged to write withdrawal from the Contract in an electronic form at info@creeme.eu. The Buyer may use the form from the subpage returns and exchange on this website. The withdrawal period shall be deemed to be maintained if the Contract Withdrawal was sent no later than the last day of the 14 days period referred to in point 4. of these Terms and Conditions. The Buyer cannot withdraw from the contract for goods contained in a protective packaging that is not suitable for protecting health or for hygiene reasons (if the customer breaks or removes the paper tag from the panties serving as a protective packaging).

If you as the Buyer make a decision to withdraw from the Contract, you are obliged to return the goods. In this case, the returned goods is underwear. Therefore, you must deliver the goods in a clean, unwashed, unused and undamaged conditions together with all original paper tags sewn on the products. (For hygienic reasons our panties cannot be tried on, bras can be tried on.) As the lingerie is made of 100% organic cotton, so please fold the items neatly back into the folded packaging to prevent strong shrinkage significant creasing during its return journey.

The Buyer must send goods back within the given time period (the date of dispatch will be decisive).

Upon withdrawal, the costs for returning the goods are paid by the Buyer, and if the Buyer withdraws from a distance contract, the cost for returning the goods by post or courier are paid by the Buyer too. Do not send the goods by cash on delivery method, the goods delivered in such a manner will not be accepted.

If all the above conditions for returning the goods are met, the money for the goods, including postage (from us to you based on the original invoice), will be returned to the Buyer in the same manner, which the Buyer used in his payment. If the buyer sends the returned goods to a different delivery address than the above, the Seller requires a 2.50 € or 65 CZK fee for delivery address correction. This amount will be deducted from the original price before the refund. The Seller is obliged to return the money per the purchase price, no later than 14 days from the date of delivery of the contract withdrawal, via bank transfer to the Buyer’s account from which the goods was paid, unless the Buyer specifies another account to which the money should be returned. The Seller is not obliged to return the payment to the Buyer before the delivery of the returned goods. The Buyer is not entitled to withdraw from the contract, if the goods were custom-made according to the special requirements of the Buyer.

The Seller reserves the right to cancel an order, especially if the goods are sold out or unavailable on the stock. The Seller shall immediately inform the Buyer about the cancellation of the order by phone or email, filled in by the Buyer during ordering. Prior to the withdrawal, the Seller is entitled to offer the Buyer a replacement performance. The Buyer has the right to refuse the replacement performance and withdraw from the Contract. In the event of payment of the purchase price or its part thereof, funds will be returned to the Buyer within 14 days from the date of notification about unavailability of the goods to the Buyer or from the Buyer’s refusal of replacement performance. The sum will be refunded to the bank account from which it was paid.

5. Goods delivery and price

We try to process your orders within 48 hours of the working day. Once the order is dispatched for shipping, we inform the Customer via email. We collaborate with warehouse Ecosam s.r.o.. They  store all our products, which go from factories to the warehouse, from warehouse to customers. They take care of our Creeme s.r.o. orders, returns, exchanges and stocks. They are responsible for processing all Creeme s.r.o. orders from Monday to Friday. If the customer place the order before 11 AM (CET), they will ship it immediately on that day. Orders placed after 11 AM (CET) will be dispatched the next working day.

5.1. Delivery of goods by Slovenská Pošta, a.s.

We send packages via Slovenská Pošta, a.s, which normally delivers goods within the Slovak Republic within one to three working days. The Seller shall not be liable for delayed delivery of goods or damage to goods caused by the delivery service provider. If you have not received any notification about the parcel deposit within seven days after our dispatch email notification, please contact us at info@creeme.eu and we will help you solve it.

We send each order only after crediting the entire amount to the account /i.e. including shipping cost. The goods cannot be ordered by cash on delivery.

We reserve the right to extend the delivery time in the event of unforeseen circumstances. The Buyer shall be informed immediately about such extension of the delivery period via email.

Shipping and packaging within the Slovak Republic:

Parcel delivery to ‘Balikobox’ – € 2.90

Parcel delivery to Post Office – € 2.90

Courier to address – € 3.30

Shipping and packaging to the Czech Republic:

Courier to address through Czech Post: EUR 3.65 = CZK 99.50

5.2. Delivery of goods by Direct Parcel Distribution SK.

We send packages via Direct Parcel Distribution SK., which normally delivers goods within EU three to five  working days. The Seller shall not be liable for delayed delivery of goods or damage to goods caused by the delivery service provider. The Buyer will receive a text or an email notification with a link to information about the delivery of the package. If The Buyer have not received any notification about the parcel deposit within seven days after our dispatch email notification, please contact us at info@creeme.eu and we will help you solve it.

6. Method of payment

It is possible only prepaid goods via credit cards for customers from the EU states to Fiobanka account or prepaid goods via credit cards or bank transfer from Slovakia. Our IBAN: SK3983300000002301279286 (accepted in EUR currency), BIC / SWIFT Code: FIOZSKBAXXX.

Or prepaid goods via credit cards or bank transfer for customers from the Czech Republic (accepted in CZK currency, without any additional fees) to account number: 2101279302/2010, IBAN: SK0483300000002101279302, BIC / SWIFT Code: FIOZSKBAXXX.

Payment by Visa and MasterCard debit and credit cards

After placing the order via www.creeme.eu, the Buyer will be automatically redirected to a secure Besteron payment gateway, where he enter the necessary data to complete the payment.

Payment by bank transfer through Slovak and Czech banks

After placing the order via website www.creeme.eu, the Buyer will be automatically redirected to Internet Banking page of his bank. The order of payment will be pre-filled with all information about the transaction – the amount, the variable symbol and our account number. If the payment is successful, the Seller will start preparing the package.

All data is safe! The Buyer always enter the information about the bank account or the card through the secure Besteron payment gateway, which is verified by the National Bank of Slovakia. The Seller cannot see his data, and do not even have access to it.

7. Warranty claim of goods

The warranty period for all sold goods is 24 months and starts on the day the goods are handed over to and received by the customer. If you want to claim goods purchased on the website www.creeme.eu, please contact us first by email at info@creeme.eu. The Seller is responsible for defects, which the sold goods have during its takeover by the Buyer. The warranty period is set for 24 months and it starts to run from the day of takeover of goods by the Buyer.

The Buyer shall submit the claimed goods together with a copy of purchase document and description of the defect to: Ecosam s.r.o., Coburgova 82, 91702 Trnava, Slovakia. Do not send the goods to us by cash on delivery, we recommend sending it as registered mail with tracking number.The goods delivered as cash on delivery will not be accepted.

The warranty does not cover normal wear and tear of the goods, which naturally changes the appearance of the cotton and the product as a whole, even in the case of metal parts based on the pH skin of the wearer’s skin; we do not consider it a relevant reason for returning the goods. The claim for free warranty also ceases to exist:

by failure to present complete goods including accessories,

by failure to report any obvious defects during the takeover of the goods,

upon expiry of the warranty period of the goods,

by unprofessional and careless treatment or neglect of care of the goods,

by mechanical damage to the goods caused by the Buyer.

The Seller shall indicate the method of handling the warranty claim immediately, in complex cases within three working days at the latest from the date of warranty claim’s submission, in justified cases, especially when a complicated technical assessment of the goods condition is required, within 30 days the latest from the day of warranty claim’s submission. The Buyer will be informed about the results of the warranty claim by phone, in writing or by email. The handling and settlement of a warranty claim may not take longer than 30 days from the day of warranty claim’s submission.

8. Warranty claim within the first 12 months from the date of purchase.

During the warranty claim’s submission by the Buyer during the first 12 months from the purchase, the Seller may handle the warranty claim by rejection only on the basis of an expert opinion; regardless of the expert opinion’s result, the Buyer may not be required to compensate for the expert opinion costs nor other costs related to expert’s opinion.

If a warranty claim is submitted by the Buyer after 12 months from the purchase and the Seller rejects it, the person who handled the warranty claim is obliged to indicate in the document on the warranty claim handling to whom may the Buyer send the goods for expert opinion.

In case that the defect can be removed, the Buyer has the right to have it removed properly, free of charge and in timely manner. The Seller is obliged to remove / repair the defect without undue delay. In case that the defect cannot be removed, and it prevents the proper usage of goods as the goods without defect, the Buyer shall have the right to exchange the goods or the right to withdraw from the Contract. The same rights shall belong to the Buyer, if the Buyer cannot properly use the product due to the repeated occurrence of the defects after the repair or because of a larger number of defects. A re-occurrence of the defect after repair shall be deemed when the same defect, which has been repaired at least twice during the warranty period, occurs again. A greater number of defects shall be deemed when the goods have at least three removable defects at the same time, each of which impedes the proper use of the product.

Settling of the warranty claim means termination of the warranty claim’s handling by handing over the repaired product, replacing the product, refunding the purchase price of the product, paying a reasonable discount from the price of the product, a written request of acceptance or justified rejection.

The Seller is obliged to issue a confirmation of warranty’s claim handling to the Buyer as well as to issue a written document of warranty’s claim handling within 30 days from the date of the warranty claim. The Buyer will be informed about the result of the warranty claim immediately after the termination of the warranty claim proceedings by email, by phone and at the same time, a copy of the warranty claim protocol will be delivered to it

9. Privacy Policy

The Seller processes the Buyer’s personal data for the fulfillment of its obligations to the Buyer arising from the Purchase contract to §10 paragraph 3 letter b) of Act no. 122/2013 Coll. on the protection of personal data and on any amendments and supplements to certain laws, in particular when issuing an invoice / tax document, contacting the Buyer in relation to the processing of his order, delivery of ordered goods, handling warranty claims. The Seller further processes the personal data in favor of the Buyer in order to keep the history of his orders and increase the comfort of his further purchases. Buyer’s personal data will not be provided to third parties.

The Seller processes the Buyer’s personal data to the extent of: first name, surname, email address, billing / invoicing address, delivery address, contact phone number, other personal data necessary to fulfill the Seller’s obligations under the Purchase Contract. The Buyer also agrees that the Seller shall provide the Buyer’s personal data necessary for the delivery of the goods to Slovenská pošta, a.s., having its registered office at Partizánska cesta 9, 975 99 Banská Bystrica, Business ID: 36 631 124, registered in the Business Register with the District Court Banská Bystrica, Insert No. 803/S and contracted courier company Direct Parcel Distribution SK, s.r.o., identification number” 35 834 498, with its registered office in Technická 7, 82104 Bratislava.

CONCLUDING NOTES

These Terms and Conditions are valid until new Terms and Conditions are issued. By placing an order, the Buyer confirms that he is familiar with the Terms and Conditions.
